Deputy Prosecutor General of the Republic of Kazakhstan Bulat Dembayev made an appeal to citizens about the messages distributed on social networks.

According to Bulat Dembayev, individuals spread false messages on social networks that allegedly the akimats of Nur-Sultan, Almaty, Shymkent, Aktobe, Aktau and Zhanaozen agreed to hold rallies on May 1 regarding military operations in Ukraine.

– This information does not correspond to reality, – said Bulat Dembayev.

At the same time, he said that on this day, akimats plan to hold only cultural events dedicated to the celebration of the Day of Unity of the People of Kazakhstan in the central squares of settlements. In addition, the Deputy Prosecutor General drew attention to the fact that the procedure for organizing and holding rallies is regulated by the Law "On the Procedure for Organizing and Holding Peaceful Assemblies in the Republic of Kazakhstan" (hereinafter – the Law), which was adopted on May 25, 2020.

A notification procedure is provided for organizing and holding meetings, rallies and pickets. "However, the organizers did not submit relevant notifications to the local executive bodies about the organization and holding of peaceful assemblies in the above-mentioned cities, or they were refused approval. Thus, peaceful assemblies organized in accordance with this Law are not provided for on May 1," he said.

Accordingly, the organization and participation in rallies held in violation of the Law (paragraph 3 of Article 3) are illegal and entail administrative liability under Article 488 of the Administrative Code of the Republic of Kazakhstan up to 25 days of arrest.

– If these actions are accompanied by significant harm to the rights and legitimate interests of citizens, organizations, society or the state, criminal liability under Article 400 of the Criminal Code, which provides for punishment in the form of a fine or correctional labor in the amount of up to 200 MCI or community service for up to 200 hours or arrest for up to 50 days. The Prosecutor General's Office urges citizens to strictly comply with the norms of the current legislation, not to succumb to provocations and refrain from participating in illegal actions. Law enforcement agencies will stop any offenses that infringe on the established order, public safety, as well as take measures provided for by law to prevent them," Bulat Dembayev stressed.
